Folti Technologies Limited owns and operates a ride-hailing platform "eDryv" that includes a website and social media pages (collectively "Website") and an application identified as eDryv offering electric-powered mobility alternatives.

Contractual Relationship

These Terms and Conditions set out the terms and conditions applying to and governing the usage of the eDryv app - technology which connects passengers with drivers to help them move around the cities more efficiently.

By signing up and using the eDryv app, you have agreed to the terms and conditions that are set out below. Any additional terms or guidelines shall be deemed to form part of these General Terms and Conditions.

General Terms & Conditions of Use

As a condition of your use of the Platform, you warrant that:

  • You possess the legal authority to create a binding legal obligation
  • You will access and use the Platform in accordance with the Legal Terms
  • You will only use the Platform in accordance with applicable laws
  • All information you provide will be true, accurate, current, and complete

Driver Feedback

Passengers are encouraged to provide feedback regarding driver behavior and overall service experience through eDryv's designated feedback channels. We value this input as it helps us maintain and improve the quality and safety of our services.

Loss of Property or Damage

Important: eDryv shall not be held liable for any loss, theft, or damage to personal property brought onto or left within vehicles during trips. Passengers acknowledge and assume full responsibility for safeguarding their belongings.

Travel Conditions and Delay

Travel times provided by the eDryv app are estimates and may vary due to factors beyond our control, including traffic, road conditions, weather, and access restrictions. eDryv shall not be held liable for any delays or inconvenience arising from such circumstances.

Passenger Conduct

No Onboard Eating: For the comfort and cleanliness of all passengers, eating onboard vehicles is strictly prohibited.

Passengers are required to conduct themselves respectfully and courteously towards drivers at all times. Any form of rude, abusive, or inappropriate behavior will not be tolerated.

Conflict Management During Trips

In the event of a conflict or disruptive behavior during a trip, drivers have the right to safely stop the vehicle to address the situation. Passengers are expected to cooperate to ensure safety and smooth continuation of the trip.

Restricted Areas

For safety reasons, eDryv reserves the right to decline or terminate trips to areas deemed unsafe, including locations prone to flooding, riots, or other hazardous conditions.

Prohibited Activities

Passengers and drivers are strictly prohibited from engaging in activities such as offering bribes, unauthorized mileage extensions, or unregistered stops. Violations may result in suspension or permanent blacklisting.

Vehicle System Protection

Passengers are strictly prohibited from tampering with or interfering with any in-vehicle systems, including advertisement screens or navigation equipment. Any damage will result in liability for repair costs.

Promotions, Rewards and Discounts

eDryv may offer promotions, rewards, and discounts, including the "Green Coin" program. These offers are subject to eDryv's sole discretion and may be modified, suspended, or terminated at any time without prior notice.

Luggage Policy

Passengers must adhere to the vehicle's luggage capacity limits as specified in the app. Each vehicle has a maximum allowed luggage limit based on its size and type.

Note: Excess luggage beyond the stated limit may result in the need for a separate rental booking. Drivers reserve the right to cancel rides in extreme situations where safety or comfort may be compromised.

Customer Support and Issue Resolution

Our customer support team strives to respond to all inquiries promptly. For unresolved issues, customers may escalate concerns to the Compliance Department at compliance@edryv.io.

Medical Emergencies

Important: Our transportation service is not equipped to provide first aid or medical assistance. Passengers are solely responsible for their own medical needs during the ride.

In the event of a medical emergency, our drivers will assist in facilitating transportation to the nearest healthcare facility if required.

Using the eDryv App

eDryv provides corporate and commercial transportation services where vehicles are company owned and operated. Services include:

  • One-off ride hailing service
  • Rental service
  • Scheduled ride service
  • In-car advertisement opportunities

eDryv In-App Payment

Payments can only be made through card payment, which requires prior activation in the eDryv app. Your payment method may be subject to additional terms from third-party payment providers.

Ordering and Cancelling Transport Services

Cancelling after driver acceptance may incur a cancellation fee. Multiple successive cancellations within 24 hours may result in temporary account blocking.

Waiting Time: Once the driver arrives and sends notification, the app may begin charging fare on a waiting time basis according to rates specified in the app.

Liability

The transportation service is provided on an "as is" and "as available" basis. eDryv's financial liability in connection with breach of contract is limited to 250,000 Naira.

You agree to fully indemnify and hold eDryv harmless from any claims or losses that result from your use of the eDryv app.

Camera and CCTV Monitoring

For safety and security, all vehicles are equipped with in-app cameras and/or CCTV systems that monitor the entirety of each journey. By using our services, you acknowledge that your journey will be recorded.

Assignment and Transfer of Carbon Emission Reduction Rights

By accessing, using, or continuing to use the services and energy services provided by Folti Technologies Limited, including any use facilitated through third-party charging stations or service providers, the Customer acknowledges and agrees that any carbon emission reductions, offsets, credits, or similar environmental attributes ("Carbon Benefits") generated through such use shall belong exclusively to the Company. The Customer hereby irrevocably assigns, transfers, and conveys to the Company all rights, title, and interest in and to the Carbon Benefits. This assignment covers all Carbon Benefits that have been generated in the past, those currently arising, and any that may arise in the future.

The Customer further acknowledges that the Company may, at its sole discretion, register, certify, verify, or otherwise formalise the Carbon Benefits under any recognised national or international carbon market, sustainability programme, or regulatory framework.

Waiver and Release of Customer Rights

The Customer expressly and irrevocably waives any rights, entitlements, interests, or claims relating to the Carbon Benefits, including those generated through third-party charging. This waiver includes, without limitation, any right to claim ownership, co-ownership, or beneficial interest in the Carbon Benefits, any right to seek recognition, compensation, participation, profit, reporting, or disclosure regarding the creation, management, or monetisation of the Carbon Benefits, against Folti Technologies Limited, its affiliates, or any third party acting on its behalf in relation to the Carbon Benefits.

The Customer acknowledges that this waiver is voluntary, informed, and enforceable to the fullest extent permitted by applicable law and forms an integral and binding part of the contractual relationship between the Customer and Folti Technologies Limited.

Exclusive Rights of the Company

The Customer acknowledges and agrees that the Company shall have full, exclusive, and unrestricted rights to use, manage, control, transfer, trade, sell, monetise, or otherwise deal with the Carbon Benefits, including those generated through third-party charging, free from any claims, encumbrances, demands, or interests by the Customer or any third party claiming through the Customer.

Customer Acknowledgement and Consent

By continuing to access or use the Company’s services and energy services, including third-party charging, the Customer confirms that they have read, understood, and accepted these provisions. Continued use constitutes ongoing consent and acceptance of the assignment and waiver of Carbon Benefits.

Scope and Applicability

These provisions apply to all current and future use of the Company’s services and energy services, including any use via third-party charging, expansions, upgrades, modifications, or renewals. The rights and obligations set out in this section shall survive termination, suspension, or discontinuation of the Customer’s use. If any part of this section is held invalid under applicable law, the remaining provisions shall continue in full force and effect.
